Des Moines Art Center Not Obligated to Remove or Repair Mary Miss’s Outdoor Installation, Judge Rules

The fate of artist Mary Miss’s Land art environment in Des Moines, Iowa, remains uncertain as a judge issued a preliminary injunction blocking the Des Moines Art Center from demolishing the outdoor installation. The dispute centers around Miss’s contract with the art center, which prevents demolition without her permission. While the court ruled against the art center demolishing the work, it also stated that they are not obligated to repair it. The installation, Greenwood Pond: Double Site, has been deemed dangerous, leading to a court-ordered stalemate. Miss welcomed the ruling, hoping for consultations about the site’s future. The art center is exploring options to resolve the situation and address public safety concerns in Greenwood Park. The installation, consisting of architectural and landscape interventions, has faced maintenance challenges over the years. Despite legal battles, supporters aim to establish Land art as a protected form under the law.
